This Cookie Policy (hereinafter: the "Policy") explains how the online store HayWay Export Marketplace, available at https://polandarmenia.com (hereinafter: the "Store" or the "Website"), uses cookies and similar technologies. The administrator of the Website and the entity responsible for the processing of data in connection with the use of cookies is HAYWAY TRADE Sp. z o.o., with its registered office at ul. Nadbrzezie 15, 31-983 Kraków, Poland, Tax ID (NIP): 6783227153 (hereinafter: the "Administrator" or the "Seller").

Please read this Policy carefully. By using the Store, the user confirms that they have been informed about the cookies used and the rules for their use on the terms described below. In matters concerning the protection of personal data, this Policy should be read together with the Store's Privacy Policy.

1. What cookies and similar technologies are

Cookies are small text files that are saved and stored on the user's terminal device (computer, tablet, smartphone) while browsing websites. Cookies usually contain the name of the website from which they originate, the length of time they are stored on the terminal device, and a unique identification number. Cookies are not used to identify the user's identity and, as a rule, do not alter the configuration of their device or the software installed on it.

"Similar technologies" include, among others, browser local storage mechanisms (local storage, session storage) and other solutions used to store information on the terminal device or to gain access to information already stored on it. In this Policy, the term "cookies" covers — for the sake of simplicity — both classic cookies and the indicated technologies of similar operation.

Cookies may be classified according to various criteria, in particular:

  • by storage time – into session cookies (stored on the device until the end of the browser session, i.e. until it is closed or the user logs out) and persistent cookies (stored for a specified period of time or until they are manually deleted by the user);
  • by origin – into first-party cookies (placed directly by the Website) and third-party cookies (placed by external entities, e.g. payment operators);
  • by purpose and necessity – into strictly necessary cookies (required for the proper operation of the Website) and cookies other than strictly necessary (e.g. functional, analytical, marketing), which require the user's separate consent.

The HayWay Export Marketplace Store uses only strictly necessary cookies and functional cookies of a limited scope. The Website does not use analytical or marketing (advertising) cookies, does not profile users and does not track their activity for advertising purposes.

2. Legal basis for the use of cookies

The use of cookies and the gaining of access to information stored on the user's terminal device is carried out on the basis of the following regulations:

  • Article 173 et seq. of the Act of 16 July 2004 – Telecommunications Law, which sets out the rules for storing information and gaining access to information already stored on the terminal device of a subscriber or end user;
  • Directive 2002/58/EC (the so-called ePrivacy Directive), concerning the processing of personal data and the protection of privacy in the electronic communications sector;
  • Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) – to the extent that the information collected by means of cookies constitutes personal data.

In accordance with the above provisions, the use of cookies that are strictly necessary for the provision of the service requested by the user (i.e. for the proper functioning of the Website, the maintenance of the session and the completion of the purchasing process) does not require the user's prior consent. The legal basis for their use is the legitimate purpose of ensuring the operation of the service provided by electronic means and, as regards personal data, Article 6(1)(b) and (f) GDPR (necessity for the performance of a contract and the legitimate interest of the Administrator in ensuring the security and correct operation of the Website).

The use of cookies other than strictly necessary (including functional cookies remembering the user's preferences) is carried out on the basis of the user's consent, expressed via a banner or information window ("cookie banner") displayed on the first visit to the Website, or through the appropriate settings of the web browser. To the extent that the data collected by means of these cookies constitutes personal data, the legal basis for its processing is Article 6(1)(a) GDPR (consent). Consent is voluntary and may be withdrawn at any time, whereby the withdrawal of consent does not affect the lawfulness of processing carried out before its withdrawal.

    • Purpose: maintaining the user's session and the contents of the shopping basket, correct progression through the order placement process, ensuring session security.
    • Storage time: session cookie – deleted automatically after the browser is closed or the session ends.
    • Type: strictly necessary, first-party.
  • Cookie consent cookie (record of the user's decision expressed in the cookie banner)
    • Purpose: remembering the fact of granting (or not granting) consent to cookies other than strictly necessary, so that the information banner is not displayed on every visit.
    • Storage time: persistent – up to 12 months.
    • Type: strictly necessary, first-party.

3.2. Functional cookies

These cookies enable the user's choices and preferences to be remembered, making the use of the Website more convenient. Their use is carried out on the basis of the user's consent. Disabling these cookies does not prevent the use of the Store, but may affect the convenience of browsing (e.g. the need to reselect the currency or language).

    • Purpose: remembering the currency selected by the user (PLN or EUR) in order to present prices in the preferred currency.

    • Purpose: remembering the language version of the Website selected by the user, so that on subsequent visits the content is presented in the preferred language.

3.3. Absence of analytical and marketing cookies

The HayWay Export Marketplace Store does not use analytical or marketing (advertising) cookies. The Website does not use web analytics tools (e.g. for counting and analysing website traffic), does not create user profiles for advertising purposes, does not display behavioural advertising and does not share data on user activity with advertising networks. We also do not use tracking technologies originating from third parties for statistical or marketing purposes.

4. Third-party cookies

As part of standard browsing of the Store and the purchasing process, the Website does not place third-party cookies for analytical or marketing purposes. Cookies of external entities appear only at the payment finalisation stage, at the moment when the user is redirected to the website of the payment operator selected when placing the order.

This concerns in particular the following payment operators:

  • PayU – processing of payments by payment card, BLIK and instant bank transfer;
  • PayPal – processing of payments via the PayPal service.

Once the user is redirected to the payment operator's environment, cookies are placed and read directly by that operator, in accordance with its own privacy and cookie policies. In this respect, the payment operators are independent data controllers and it is they who are responsible for the technologies they use. We recommend that you familiarise yourself with the cookie and privacy rules applicable to the relevant operator – this information is available on the official websites of PayU and PayPal, in the sections devoted to privacy policy and cookies. The Seller has no influence over the content of these policies or the scope of cookies used by the payment operators.

The user may change these settings at any time so as to block the automatic handling of cookies or to be informed of each instance of their placement on the terminal device.

  • Google Chrome: menu (three dots) → "Settings" → "Privacy and security" → "Cookies and other site data"; here you can manage saved cookies and specify the rules for blocking and deleting them.
  • Mozilla Firefox: menu (three horizontal lines) → "Settings" → "Privacy & Security" → the "Cookies and Site Data" section; this allows you to clear site data and configure protection against tracking.
  • Apple Safari: the "Safari" menu → "Settings" (or "Preferences") → the "Privacy" tab; this allows you to block cookies and manage site data. On the mobile version: the system "Settings" → "Safari" → the "Privacy & Security" section.
  • Microsoft Edge: menu (three dots) → "Settings" → "Cookies and site permissions" → "Manage and delete cookies and site data".
